Terms and Conditions

Service

Nautispot and Clube Nacional de Ski Náutico (CNSN) reserve the right to make changes to the Service strictly necessary to comply with applicable legislation and/or safety standards, notifying the daily member and/or guest in advance.
No external food is allowed on the property called private lagoon of Herdade do Zambujeiro, CCI 8, unless expressly authorized in writing by Nautispot or CNSN.
All food provided on the place where’s located the private lagoon of Herdade do Zambujeiro, CCI 8, is for the exclusive consumption of Members and guests.

Member Obligations

The daily member and/or guest must:

- Cooperate with Nautispot and CNSN on all matters related to the use of the space and equipment;
- Pay a daily fee to use the space;
- Provide all information that Nautispot and CNSN deem necessary for the use of the space and equipment in a timely manner;
- Comply with and enforce the regulations and rules of Nautispot and CNSN;
- Respect and follow all instructions from the team and staff, under the risk of having to immediately leave the space and exit the property called private lagoon of Herdade do Zambujeiro, CCI 8, for non-compliance.

Service Price

For the use of the space and equipment, Nautispot and CNSN add the value of VAT at the legal rate in force to the amount due.

Damages

The daily member and/or guest is responsible for complying with applicable legislation, for themselves and for minors under their supervision.
The daily member and/or guest will be responsible for any damage or harm caused to people or the property of Nautispot and CNSN or even the space itself.
The costs of repairing or replacing goods resulting from the damage caused will be charged to the daily member and/or guest;
Nautispot and CNSN will not be responsible for any accidents, losses, damages, or thefts, voluntary or involuntary, causing damage and generating civil or other liability, that the daily member and/or guest, or any other participant may suffer, namely to their goods, materials, equipment, or vehicles parked inside the property.

Intelectual Property

Any use of the names, brands, or logos of Nautispot and CNSN requires their express authorization.
The daily member and/or guest authorizes Nautispot and CNSN to use their image and those they represent under their supervision, in video or photograph format for publication on their website and social networks to promote the space.
If the daily member and/or guest does not accept the point described above, they must do so simultaneously with the signing of this declaration and in writing.

Responsibility Term

For all due purposes, the daily member and/or guest declares that:
- They aware of the risks involved in sports activities and the use of the equipment in this space;
- Will use the equipment and participate in sports activities of their own free will, declaring and confirming that they are physically fit and have no physical, mental, or psychological incapacity that may affect any sports activity;
- Whenever they enter the Lagoon, they will do so using a life jacket, declaring that they will never enter the water without using the safety equipment;
- They are sole and exclusive responsible for minors (< 18 years) who use the space where the Lagoon and its equipment are located and who are there accompanying them, also declaring that they are under their sole and exclusive supervision, being the only responsible for them and for ensuring their custody, being obliged to maintain permanent supervision of the said minors to ensure their safety so that nothing happens to them, and guarantees and assumes that they will only enter the water accompanied by them and using the life jacket;
- Also declare that they irrevocably exempt Nautispot and CNSN, as well as their managers, from any responsibility for the use of the space and its equipment, for any eventual damage caused to their physical integrity and the minors who accompany them and who are under their responsibility and supervision, as well as for damages caused to their personal equipment during such practices in the private lagoon of Herdade do Zambujeiro, CCI 8;
- They are fully aware of the risks that may arise from the use of the Lagoon and its equipment, as they are high-risk radical activities, but even being aware of such risks, they declare that they intend to use the lagoon and its equipment of their own free will, irrevocably renouncing the right to claim any compensation from Nautispot and/or CNSN for any accident that may occur during the use of the space and its equipment, being the sole responsible, as they decided to do so of their own free will;
- They further declare that they are of legal age as applied in Portugal (18 years);
- They further declare that they are solely responsible and have exclusive custody and supervision while using the lagoon and its equipment over the following minors:

By agreeing to the terms stipulated in this responsibility term and by their will to use the lagoon and its equipment, despite the risk warnings that were transmitted to them, they sign this declaration to irrevocably exempt Nautispot and CNSN from any responsibility for any incident that may occur during their use of the lagoon and its equipment, as well as the minors who are under their supervision.

*This document is valid indefinitely and is valid for all present and future uses by this daily member and/or guest.
